What should someone do if they are accused of a sex crime?

Being accused of illegal sexual behavior is very serious. It is almost never a good idea to give a statement to police officers about any kind of sex crime accusations.

If you cannot afford a private attorney, you can get help from the public defender’s office. You should never try to handle being charged with a sex crime by yourself. There is too much at risk.

What are the consequences of being convicted of a sex crime?

The penalties for sex crimes can include time in prison and lengthy probation and parole. The exact penalty for a particular crime can depend on the alleged victim’s age, the amount of force that was allegedly used, the alleged victim’s relationship to the person who is accused, and other alleged crimes that are part of the same incident, such as kidnapping, for example.

In addition to the penalties for the crime itself, most people convicted of a sex crime will have to register as a sex offender. If the convicted offender continues to live in New Mexico, registration will be required for at least ten years and sometimes for the rest of his or her life. If the convicted offender moves to another state, he or she will still have to register according to the laws of the other state. Failure to register, in any state, is a crime.

If you are required to register as a sexual offender, you may encounter many other problems. By law, you will not be allowed to take certain kinds of jobs, for example, and you will not be allowed to live in certain neighborhoods. Until recently, people on the sexual offender registry couldn’t even use a public library in New Mexico.

Because the penalties related to sex crimes are very severe, and because many sex crime cases are based on nothing more than one person’s word against another’s, it is very important that you work with an attorney if you are accused of a sex crime.
