The Third Amendment to the US Constitution guarantees that citizens cannot be forced to allow the government into their homes. This is a civil right, which, if violated, can be remedied with a civil rights lawsuit against the law enforcement entity.
The Third Amendment reads:
“No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.”
This constitutionally guaranteed right appears to have been violated in one of our sister states. In Nevada, a man was told that police needed to occupy his home to get a “tactical advantage” on the occupant of a neighboring house. According to the civil rights lawsuit, when the man refused, the police busted through his door, hit him with pepper balls, and arrested him. He was charged with obstructing an officer.
This type of behavior by police is a gross violation of a person’s civil rights and should not be tolerated.
